Alamo RMA Statement on Judge Biery's Denial of AGUAs request for injunction
Dr. William E. Thornton, Chairman of the Alamo Regional Mobility Authority (Alamo RMA) today issued the following statement regarding the denial of AGUA’s motion for preliminary injunction, which sought to stop all construction of the US 281 at Loop 1604 Interchange.
“We are thrilled with Judge Biery’s order today, denying AGUA’s motion for a preliminary injunction. As Judge Biery stated in his opinion, the Alamo RMA, TxDOT and the Federal Highway Administration followed the procedures and requirements of the National Environmental Policy Act in moving forward with the clearance and now the construction of this long awaited and much needed interchange to help solve one of the worst safety and traffic spots in our entire community.
“By seeing the actions taken during the environmental clearance, and now the actions being taken during construction to safeguard our aquifer, Judge Biery has confirmed our actions and decisions in bringing protections to this corridor are indeed in the public interest.
“With over 10,000 pages of administrative record on this project, with the extensive and detailed ongoing environmental protections being added to this area as part of this project, and with the comprehensive and through environmental monitoring being done as part of this construction, we are confident that this needed project will be looked upon as an example of best practices in providing relief and protecting our precious natural resources.
“We look forward to the resolution of this lawsuit, and we look forward to the successful completion of the US 281 at Loop 1604 Interchange project by the summer of 2013.”
